The
Labor Certification
program or PERM Labor Certification
is designed to ensure that the employment of foreign workers on a
permanent basis will not adversely affect the job opportunities, wages,
and working conditions of U.S. workers. A permanent labor certification
issued by the Department of Labor allows an U.S. employer to hire a
foreign worker to work permanently in the United States.
The
Labor Certification is also called the PERM (Program
Electronic Review Management) Labor Certification
application, which is an attestation by an U.S. employer that it has
conducted a test of the labor market in the local area for the position
for which a foreign employee is being sponsored, and that it has failed
to find U.S. workers who are qualified for the position. The PERM Labor
Certification is the first step for a foreign worker to obtain an
employment-based immigrant visa or green card. The employment-based
preference categories that require PERM labor certification are EB-2
and EB-3, but not include the EB-2 National Interest Waiver.

Labor
Certification Application Process,
Requirements, and Resources
For
most foreign nationals seeking employment based permanent resident
status or green card, the first stage in the long process is to
file a labor certification application which is processed by
the U.S. Department of Labor (DOL). Before a U.S. employer can file an
immigration petition for a foreign worker with U.S. Citizenship and
Immigration Services (USCIS) in most EB-2 and EB-3 positions, the
employer must first obtain an approved labor certification from the DOL.
An
application for labor certification is
submitted to the DOL by using ETA Form 9089. The
DOL must certify to the USCIS both that there are not sufficient U.S.
workers able, willing, qualified, and available to accept the job
offered the alien at the prevailing wage for that occupation in the
area of intended employment, and that employment of the foreign worker
will not adversely affect the wages and working conditions of similarly
employed U.S. workers. The questions in the PERM application form
include whether the employer provided notice to its employees, whether
the alien beneficiary gained any of the qualifying experience with the
employer, whether the alien is currently employed by the employer,
whether proficiency in a foreign language is required to perform the
job duties, and whether U.S. applicants were rejected for solely job
related reasons.
