After PERM Approval, Do I Need to Keep H-1B Working Status to Apply for U.S. Green Card?

Hi William,

As a recent college graduate, my employer will apply the
PERM Labor Certification for me soon. After the PERM labor certification approval, do I need to keep the working status such as H-1B to apply for the U.S. Green Card?

Answer,

The PERM Labor Certification is the first step in U.S Green Card application
process. The foreign students studying in U.S. should begin the PERM process as soon as possible after graduating from U.S. University and entering the workforce.

After the
PERM labor certification approval by U.S. Department of Labor, it will serve as a basis for Green Card application. But the PERM approval does not directly lead to U.S. immigration status to the beneficiary. Therefore, if you wish to stay in the U.S. during the whole Green Card application process, you should be in valid nonimmigrant status in the United States, and you should be in a status that provides a form of work authorization, such as H-1B status in United States.

If you are in the Curricular Practical Training (CPT) currently, you can use the work experience to meet a PERM application's experience requirement.
