William, My employer will file the Permanent Labor Certification application for me. What is the next step to get the U.S. Green Card after the Labor Certification approval? Answer, In general, petitioners filing EB-2 and EB-3 petitions must first obtain an approved permanent labor certification application from DOL on behalf of the beneficiary. An approved permanent labor certification application demonstrates that: 1) The petitioner tested the labor market in the geographic area where the permanent job offer is located to establish that there are no able, qualified, and available U.S. workers who are willing to accept the permanent job offer; and 2) The employment of the beneficiary will not adversely affect the wages and working conditions of similarly employed U.S. workers. DOL processes Applications for Permanent Employment Certification, ETA Form 9089. The date the labor certification application is received by the DOL is known as the filing date, and is used by USCIS and the Department of State as the priority date. After the labor certification application is certified by DOL, it should be submitted to the appropriate USCIS Service Center with a Form I-140, Immigrant Petition for Alien Worker. The certification has a validity period of 180-days and expires if not submitted to USCIS within this period. |
