How to Qualify the EB-1A Green Card Application and Meet Its Requirements?

Hi William,

I am a researcher in a large pharmaceutical company, with a Master degree and several publications. How could I
qualify the EB-1A Green Card application and meet its requirements?

Answer,

To qualify for the EB-1A visa, you must demonstrate extraordinary ability in a field such as science, arts, education, business, or athletics. A EB-1A Form I-140 application filed for an alien immigrant with extraordinary ability must demonstrate that the alien applicant has a level of expertise that the alien has risen to the top of the field. Evidence must be submitted to support a Form I-140 application for an alien of extraordinary ability. An EB1 Extraordinary Ability application must be accompanied by initial evidence such as:

a) The alien applicant has sustained national or international acclaim;

b) The alien applicant’s achievements have been recognized in the field of expertise.

Many new immigrants may wonder whether they could qualify for the EB-1A immigration visa classification. The common misunderstanding could be that the EB1 Extraordinary Ability immigrant visa application is very hard to get approval. Therefore, many people with extraordinary ability may not normally apply for Green Card in this EB-1A category.

Because the EB-1A category is in the First Preference, and the immigrant visas are often immediately available. Normally, people may expect the applicants with extraordinary ability to have Ph.D. degrees, but the USCIS regulations do not require a Doctorate Degree for the EB-1A beneficiary.

The following are some issues to know about the EB-1A Green Card application:

1) Processing time: The EB-1A visa typically has a waiting time of around 4 to 6 months, the premium processing can get it done in 15 days, with premium processing fee.

 2) Fewer applicants: The EB-1A visa has fewer applicants than other visas, so there are fewer backlogs.

3) No job offer required: Unlike other visas, the EB-1A does not require a job offer or employer sponsorship.
