I want to file the I-140 in the EB1-Outstanding Researcher category with the newly available Premium Processing. Is it still available to file the concurrent I-140/ I-485 applications with the Premium Processing? and should I file with which USCIS Service Center? Thank you.

Answer:

It is still available to file the concurrent I-140/ I-485 applications with Premium Processing. All concurrent I-140/ I-485 applications should be filed with the USCIS Nebraska Service Center at this time. According to the USCIS Bi-Specialization procedure requirement, the I-485 application should not be filed with any other Service Centers, but the Nebraska Service Center.

For the concurrent I-140/ I-485 application filing with Premium Processing, only the I-140 petition will be processed in Premium Processing. The accompanying I-485 application and EAD/ AP applications will be processed under the normal processing service time, not in the Premium Processing.
