Can I Use My Employer's Certified Labor Certification with only a Three-year College Degree |
Dr. William:
My employer has an approved Labor Certification which requires a bachelor's degree for the job. I do not have a four-year bachelor degree, but have a three-year college degree and 4 year working experience in the field. Can I use my employer's certified Labor Certification? or I must have a four-year bachelor degree to use it?
A: If the approved Labor Certification clearly requires a bachelor's degree and you only have a three-year college degree, then you can not use the approved Labor Certification.
On the other hand, if the approved Labor Certification requires a bachelor's degree or its "equivalent", and you have a three-year college degree and 4 year working experience in the field, you may be able to use the Labor Certification, as an "equivalent" of the four-year bachelor degree by combining your college education and 4 year working experience.
