Do I Have to Have a New Job or Job Offer for My I-485 to Get Approved? |
Dr. William:
My I-485 has been pending for more than 180 days. I want to change job under the AC-21 of I-140 portability provisions, do I have to have a new job or job offer for my I-485 to get approved?
Answer:
If you want to change job under the AC-21 of I-140 portability provisions, you need to have a valid new job or a new job offer for your I-485 approval.
You cannot have no job or still are looking for “same or similar” employment at the time of the I-485 adjudication under the adjustment portability provisions. You need to show to USCIS that you have a new valid job or job offer of employment at the time of your I-485 adjudication.
