My employer will soon file a PERM labor certification for me as a software engineer. Consider the recent many PERM applications being rejected, I have a question about the bachelor degree requirement for the position: I do not have a bachelor degree in Computer Science, but I have a Master degree in Computer Science. Do you think this will be a problem?
Answer:
If a labor certification requires a bachelor's or equivalent foreign degree in a certain field of study, you will still be considered qualified for the position at the I-140 stage if you have a master's degree in that field, even if the bachelor's degree is in another field of study, since the PERM labor certification sets forth minimum qualifications for a position.
