Submit New Research Project Documents for I-140 NIW Petition 

Dr. William:

I have been working as a post-doc in a national institute for cancer research. I applied for my I-140 about 5 months ago in Vermont service center. But now, I am working on new project funded by Department of Homeland Security for new bacteria research. Do you think that it may increase my chance of I-140 approval, if I submit some documents about my new research project and explain its relationship with U.S. National Interests? Your advise would be highly appreciated.


Answer:

According to USCIS' explanation for EB1 and NIW petitions, the beneficiary's qualification should be established before filing the petition. Normally, USCIS will not accept document or evidence achieved after the I-140 petition. But if you get Request For Evidence (RFE) later from USCIS, you may submit documents about your new research project and explain its relationship with U.S. National Interests at that time.
