What Is My Priority Date To Qualify The 7-year H1B Extension?

Dr. William:

My employer and lawyer filed RIR Labor Certification for me last year, but my RIR Labor Certification case was denied by VSC due to my company's downsize.

Now my case is a regular Labor Certification, and my H-1B status will reach 6 year limit soon. If I want to apply for 7-year H1B extension, what is my priority date of the the AC-21's 360-day of Labor Certification, for me to qualify the 7-year H1B extension?

A:

Even your RIR Labor Certification application was denied by VSC. You still will keep the original filing date as your priority date. So your original filing date of RIR Labor Certification will be used to count as the beginning day of the the AC-21's 360-day of Labor Certification, for your 7-year H1B extension.
