What Is the Regulation of the Admission Requirement for a Returning U.S. Resident?

Dr. William:

I am a U.S. permanent resident, and I want to stay in another country for more than one year due to business reason. What is the regulation of the admission requirement for a returning U.S. resident?

A:

Before the traveling, you need to file Form I-131 of Application for Travel Document as your reentry permit. Without the reentry permit, it may lead to the termination of your permanent resident status for abandonment. The current USCIS practice is to check the Travel Document when presenting yourself for inspection at a port-of-entry.

The USCIS intends to a regulation to terminate the permanent resident status of an alien, when they notice that he/she has remained outside the U.S. for a continuous period of over one year since his or her departure from the United States, if it is determined that such alien has abandoned his or her permanent residency and is no longer eligible for admission as a returning resident.
