I have a Master degree in Chemistry and more than 5 years of working
experience. I want to apply for Green Card in EB-2 category, because I do not
believe that I may qualify for EB1. What is the major
difference of normal EB2 and NIW?
Answer:
The EB-2 normally requires Labor Certification and it has
to be filed by your employer. However, for NIW petition, the Labor Certification
is waived.
For other EB-2 immigration categories, an applicant must
go through a Labor Certification process, which is lengthy and painful, and
needs an employer's long time support. Thus, the NIW offers great advantages to
a petitioner.
