Your Previous Labor Certification is not Transferable

Dr. William:

I work in a company in state of Oregon at H-1 visa from 1994-1997. I applied for immigration. I received labor certification and then the company closed. That labor certification came after the company's technology was sold to another company in California.

Now, I have another job with my current company. I want to apply for immigration. This process takes longer. I want to know if I can use my previous certification. This is a research and development company. I worked with research and development company before. Can you please guide me on this issue. Thank you.

A:

The answer is no.

Your labor certification is not transferable. You can not use labor certification from company A used for the current job in company B. You need to redo labor certification based on your current position in new employer.
