Can I Use My Labor Certification from Previous Employer?

Dr. William:

I am now working for a pharmaceutical company A. I have worked with pharmaceutical company B from 1994-1997. I applied for immigration at that time, and I received labor certification. Then the company closed. The labor certification came after the company's technology was sold to another company in California.

Now, I have a job with company A. I want to apply for immigration. This process takes longer. I want to know if I can use my previous labor certification from company B.

A:

The answer is no. Your labor certification is not transferable. You can not use labor certification from company B used for the current job in company A. You need to redo labor certification based on your current position with the new employer
